JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Anurag Kumar, Advocate Mr. Sanjay Kumar Pandey, Advocate. For the State : Mr. Jitendra Pandey, Addl.P.P For the Opp. Parties : Mr. Rahul Pandey, Advocate. Mr. Bhanu Kumar, Advocate. ------ Order No.04 Dated- 11-05-2026 Heard the parties. The petitioner has been made accused in connection with Satgawan P.S. Case No. 109 of 2025 registered for the offence punishable under Sections 316(2)/318(2)/336(3)/338/352/351(2)/3(5) of the Bharatiya Nyaya Sanhita. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused person has cheated and taken Rs.2,00,000/- from the informant for selling land, but he neither is returning the same nor selling the land. It is next submitted that the agreement was entered between the petitioner and the co-accused Ram Kishor Choudhary. It is further submitted that the petitioner has falsely been implicated in this case. It is next submitted that the petitioner is neither the owner of the land nor entered into any agreement with the informant. It is then submitted that the dispute between the parties is at best a civil dispute arising out of a land transfer and a cloak of a criminal case has been given to purely a civil dispute. It is also submitted that the allegation against the petitioner is false. It is further submitted that the co-accused person has been given the privilege of anticipatory bail by the co-ordinate Bench of this Court vide order dated 20.03.2026 in A.B.A. No.1042 of 2026. It is further submitted that the petitioner undertakes that he will co-operate with the trial of the case and will not annoy or disturb the informant or witnesses of the case. It is lastly submitted that the petitioner has no criminal antecedent, as mentioned in para 03 of the supplementary affidavit and he has been in custody since 02.12.2025 as mentioned in para-14 of the instant bail application. Hence it is submitted that the petitioner be released on bail. Learned Addl.P.P. and learned counsel for the opposite party no.2 vehemently opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Koderma in connection with Satgawan P.S. Case No. 109 of 2025 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the informant or witnesses of the case in any manner during the trial of the case.
