Heard learned counsel for the petitioner and Sri Saurabh, learned Standing Counsel for the State-respondents. This writ petition has been filed with the prayer to quash the order dated 17.07.2026 passed by the District Inspector of Schools (DIOS), Kanpur Nagar, and the consequential formal suspension order dated 23.07.2026 issued by the Manager of the Committee of Management of the Institution. Learned counsel for the petitioner submits that the petitioner retired from service on 30.09.2026. He further submits that, on the basis of allegations of illegal promotion and financial irregularities said to have occurred in the year 2002, the petitioner has been placed under suspension without proper notice or enquiry, and that a recovery order has also been passed against him. Mr. Saurabh, learned Standing Counsel, submits that the enquiry shall be concluded within a period of two months in accordance with the procedure prescribed by law, as the allegations leading to the suspension order are serious in nature. In view of the above, no interference is called for. However, since the recovery order has been passed without a proper enquiry, the recovery shall remain stayed until the conclusion of the enquiry and shall be subject to the final order passed therein. The post-retiral benefits of the petitioner shall also be subject to the final order passed after conclusion of the enquiry. With the aforesaid observation, the writ petition is disposed of.
