This is first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.80/2025 registered at Police Station - Basantpur District - Balrampur-Ramanujganj (C.G.), for the offence punishable under Sections 108 of Bhartiya Nyay Sanhita in short BNS, 2023. 2. The prosecution story in brief, is that on 03.04.2025 the deceased committed suicide and it is apprehension of the prosecution that deceased committed suicide because of the fact that the marriage of VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.01.21 14:58:18 +0530 2 deceased was fixed with one Rajesh Kannojia and the date of marriage was fixed at 19.04.2025, applicant after getting knowledge of the fixation of marriage on 02.04.2025 sent photographs of the deceased along with him of the college days to Rajesh Kannojiaand his family members and deceased was embarrassed about the same and subsequently on 03.04.2025 committed suicide by jumping on well. 3. Learned counsel for the applicant submits that applicant is innocent and has falsely been implicated in present case. He also submits that the allegation levelled against the applicant is that the marriage of deceased was fixed with one Rajesh Kannojia and after getting knowledge of the fixation of marriage, applicant sent photographs of the deceased along with him of the college days to Rajesh Kannojia and his family members and deceased was embarrassed about the same and subsequently on 03.04.2025 committed suicide by jumping on well. He further submits that out of 17 prosecution witnesses, only four witnesses have been examined and turned hostile and applicant is in jail since 27.04.2025. He further submits that applicant is having no criminal antecedents, therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, learned State counsel opposes the prayer for grant of bail and submits that the marriage of the deceased was fixed with Rajesh Kannojia and applicant is having some relationship with the deceased and applicant sent photographs to Rajesh Kannojia and his family members, subsequently on 03.04.2025 deceased committed suicide by jumping on well. Hence, the present applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case 3 diary. 6. Taking into consideration the fact and circumstances of the case, submissions made by learned counsel for the parties, allegation levelled against the present applicant, also looking to the conduct to the applicant, thus this Court is of the view that it is not a fit case to release the applicant on bail. 7. Accordingly, the bail application of the applicant namely Ashish Kumar involved in Crime No.80/2025 registered at Police Station - Basantpur District - Balrampur-Ramanujganj (C.G.), for the offence punishable under Sections 108 of Bhartiya Nyay Sanhita in short BNS, 2023, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
