The petitioner is apprehending his arrest in connection with Muffasil P.S. Case No. 243 of 2024, registered for the offence under Sections 191(2), 191(3), 190, 115(2), 126(2), 118(1), 109 and 85 of Bhartiya Nyaya Sanhita, 2023 and Sections 3 and 4 of Dowry Prohibition Act, pending in the court of learned Chief Judicial Magistrate, Hazaribag. 3. Learned counsel appearing for the petitioner submits that for the same allegation earlier the informant has lodged a case being Muffasil P.S. Case No.228 of 2023 in which the petitioner has obtained the bail and thereafter, the present case has been lodged on the same allegation. He submits that false allegation has been made of demand of dowry and torture and even injury is said to be simple. 4. Learned counsel appearing for the State has opposed the prayer and submits that the petitioner happens to be husband and allegations are there of assault. 5. Considering that the petitioner is husband and earlier Muffasil P.S. Case No.228 of 2023 was filed by the wife and thereafter the present case has been filed on the same allegation, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within two weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hazaribag, in connection with Muffasil P.S. Case No. 243 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Anit Uploaded 08.05.2026
