2023. 3. Mr. Choudhury, learned Senior Counsel for the accused applicant, submits that the accused applicant, along with her husband, namely, Amir Ali, was arrested in connection with Gorchuk P.S. Case No. 103/2026 on 11.05.2026. He submits that after the investigation, the police submitted the charge-sheet on 10.08.2026, which was beyond the statutory period of 90 days. In view of the aforesaid, the husband of the accused applicant has already been enlarged on bail, vide order dated 13.08.2026, passed by the learned Sessions Judge, Kamrup(M), Assam. The learned Senior Counsel submits that since the same principle should be applied to the wife also, the accused applicant should be granted bail. 4. Mr. Choudhury, learned Senior Counsel, has submitted the order dated 13.08.2026, and the same is kept on record by marking it as ‘X’ for identification. 5. Mr. Goswami, learned Addl. P.P., submits that, as per the Investigating Officer’s report, the charge-sheet was submitted on 09.08.2026. However, taking into account the order passed by the learned Sessions Judge, Kamrup (M), this Court is of the considered opinion that the accused applicant should also be granted bail on the ground that the charge-sheet was filed beyond the statutory period of 90 days. 6. Accordingly, it is directed that the accused applicant shall be released on bail on furnishing a bail bond of Rs. 30,000/- (Rupees Thirty Thousand) with one surety of like nature to the satisfaction of the Jurisdictional Magistrate, subject to the following conditions:
Page No.# 3/3 i. That the accused applicant shall cooperate with the investigation and make herself available as and when called for; ii. That the accused applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade such person from disclosing such facts before the Investigating Authority; and iii.
That the accused applicant shall not try to hamper or tamper with the investigation in whatsoever manner. 7. In view of the aforesaid directions, the instant bail application stands
