ORDER Date : 06.08.2026 Heard Mr. M. K. Hussain, learned counsel appearing for the appellant. Also heard Mr. B. Sarma, learned Additional Public Prosecutor appearing for the State respondent. By way of this application under Section 430 of the BNSS, 2023, the accused/applicant is seeking suspension of sentence and allowing the accused/applicant to remain on previous bail during the pendency of the connected appeal. It appears that the learned Additional Sessions Judge, Biswanath in SPL (Electricity) Case No. 11/2016 by the judgment dated 10.07.2026 convicted the applicant and sentenced him thereof to pay a fine of Rs. 63,936/- (Rs. 21,312/- x 3) in default to undergo simple imprisonment of 3 months under Section 135 of the Electricity Act and to pay a fine of Rs. 1000/- in default to undergo simple imprisonment of 7 days under Section 353 of the IPC. It appears that the applicant was in bail during trial and has not taken undue advantage of liberty granted by the trial Court. Upon hearing the learned counsel for the parties and upon perusing the material available on record, it appears that there are strong arguable grounds made in the appeal. Accordingly, judgment dated 10.07.2026 passed by the learned Additional Sessions Judge, Biswanath in SPL (Electricity) Case No.
Page No.# 3/3 11/2016, remains suspended until further orders. The accused/applicant is allowed to remain on previous bail. Resultantly, the instant interlocutory application stands
