After arguing for a while, the learned counsel appearing on behalf of the petitioner submits that the petitioner would feel satisfied in case the instant writ petition is disposed of at this stage with a direction to the respondents to treat the same as a representation and accord consideration to the same within a reasonable period. 02. On asking of the Court, Mr. Furqan Sofi, learned Government Advocate caused appearance and accepted notice on behalf of the respondents and he is not averse to the disposal of the instant petition by treating the same as representation. However, he submits that the representation of the petitioner would be considered strictly in conformity with the law and the rules governing the field. 03. Heard learned counsel for the parties at length and perused the record. 04. With the consent of the learned counsel for the parties, the present writ petition is taken up for final disposal at the very threshold as an innocuous prayer has been made by the learned counsel for the 107 Suppl-I petitioner and the same is accordingly disposed of with a direction to the respondent No. 2 to treat this writ petition as representation on behalf of the petitioner and accord consideration to the same within a period of four weeks from the date of receipt of copy of this order along with copy of writ petition and the annexures appended thereto, strictly in conformity with the rules and as per law. 05. It is made clear that while according consideration to the representation, the respondent No. 2 shall give due weightage to communication No. SICOP/DM(M)/14/507-08 dated 11.06.2014, which has been placed on record as Annexure-I issued by the Deputy General Manager, SICOP, Srinagar to the Block Development Officer, Lar Ganderbal, in terms whereof the Divisional Manager, SICOP, Srinagar had requested the concerned Block Development Officer to make necessary arrangements for release/transfer of the amount to the tune of Rs. 2,38,484/-, being the admitted payment payable to the petitioner under different works executed by him. 06. The order of consideration to be passed shall be forwarded to the petitioner through registered post. Needless to say, in case the respondents intend to hear the petitioner in person, the same may be done after issuing notice to the petitioner in advance, and in that eventuality, the petitioner shall be at liberty to produce the requisite documents, if required.
