Learned advocate appearing for the petitioner submits that the subject matter of the case relates to recovery of 128.6 Kgs. of Ganja from Dipak Ranjan Pradhan and Soumya Ranjan Sahoo and the present petitioner has been implicated on the basis of statement of co-accused. However, learned advocate in his fairness submitted that although charge sheet was submitted on 29th of July, 2022 and subsequently, harsher process of law was issued and the case against the petitioner was filed on or about 28th March, 2024. Petitioner was shown arrested in connection with the instant case after he was arrested in connection with a case of Orissa. 2
Learned advocate submits that via video-conference in the month of December, 2025 petitioner has been shown to be arrested in connection with the instant case and till date only 3 witnesses have been examined by the prosecution. Learned advocate for the Union of India opposes the prayer for bail and submits that petitioner was evading the process of law. He has antecedents and only 2 witnesses are left by the prosecution to be examined. Be that as it may, petitioner has just entered the process of trial. It is for the Trial Court to exercise its discretion how to proceed with the trial of the case. Having considered the quantum of seizure in the present case and the period for which the petitioner was not available before the Court, I am of the view it is not a fit case for granting bail. Accordingly, the prayer for bail of the petitioner is rejected. Thus, CRM (NDPS) 1697 of 2025 is dismissed. Report submitted by the NCB be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
