04/14.05.2026 Heard learned counsel appearing for the petitioners and learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Ormanjhi P.S. Case No.33/2026, registered for the offence under Section 325 of the BNS and Section 11(1)(a) of Cruelty to Animals Act and Section 12 of Jharkhand Bovine Animal Prohibition of Slaughter Act, 2005, pending in the Court of the learned Judicial Magistrate, 1st Class, Ranchi.
3.
Learned counsel appearing for the petitioners submits that the petitioners are indulged in purchasing and selling of bovine animals. She further submits that the allegations are made that bovine animals were being carried for the purpose of slaughter, however, that fact is not correct. She next submits that the bovine animals were purchased from the market. To buttress this argument, she refers to Annexure-2, which are receipts of
( 2026:JHHC:14788 ) -2- A.B.A. No. 2626 of 2026
purchasing bovine animals. She also submits that the petitioners are having no criminal antecedent, as disclosed in paragraph 14 of this application.
4.
Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of carrying bovine animals for slaughter.
5. Annexure-2 is the document, which prima facie suggests that the petitioners have purchased the bovine animals and the number of bovine animals in the respective receipts have also been shown. In the attending
facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners.
6. Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Ranchi in connection with Ormanjhi P.S. Case No.33/2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
