Das, learned Standing Counsel, Social Justice & Empowerment Department, Government of Assam for the opposite party nos. 1 & 4; Mr. N. Das, learned Junior Government Advocate, Assam for the opposite party nos. 2, 6, 7 & 8; and Ms. P. Baruah, learned Central Government Counsel for the opposite party no. 5. 2. This application is filed by the applicant seeking impleadment of Chah Janajati Jatiya Sanmilani, Asom, Central Committee, Rup Nagar, Guwahati-32, Assam as party-respondent no. 9 in the accompanying writ petition, that is, W.P.[C.]/3842/2026. 3. The applicant as the writ petitioner has preferred the accompanying writ petition, W.P. Page No.# 5/6 [C.] no. 3842/2026 seeking inter-alia a direction to the District Commissioner, Sonitpur to issue a Caste Certificate in continuation of the petitioner’s previous Caste Certificate dated 15.06.2020 wherein the petitioner has been recognized as a person belonging to Koiri Ex-Tea Garden Labour Tribe [Ex-TGL], which is recognized as More Other Backward Class [MOBC], in the State of Assam. 4. It is stated that during the course of deliberation of the writ petition, a Notification dated 29.03.2022 issued by the Welfare of Plain Tribes & Backward Classes Department, Government of Assam has been placed. By the Notification dated 29.03.2022, the Governor of Assam has authorized the President and General Secretary of the Central Committee and its District Committee of Chah Janajati Jatiya Sanmilani, Asom to give its endorsement in the name of the original tribe/sub-tribe/caste/sub-caste of the applicant applying for MOBC certificate as Ex-Tea Garden Labour Tribe [Ex-TGL], prior to issuance of the Certificate by the District Commissioner. It is averred that in view of the Notification dated 29.03.2022 impleadment of the organization, Chah Janajati Jatiya Sanmilani, Asom has become necessary for adjudication of the issues involved in the accompanying writ petition. 5. The learned counsel appearing for the opposite parties have submitted that they have no objection to the prayer for such impleadment made on behalf of the applicant-writ petitioner. 6. In addition to the prayer for impleadment, the applicant-writ petitioner has also sought amendments in the writ petition, by way of insertion of a paragraph as Paragraph no. 10A and of an additional prayer as Prayer [‘f’]. The amendments sought as Paragraph no. 10A and Prayer [‘f’] in the writ petition are quoted in Paragraph – 5 of the application. 7. The learned counsel appearing for the opposite parties have submitted that since the amendments sought for by way of insertion of Paragraph no. 10A and Prayer [‘f’] to the writ petition is connected with the prayer for impleadment of party-respondent no. 9, they have no objection to the prayer for amendment. 8. In the above view of the matters, the prayers are allowed. Page No.# 6/6 9. As the prayers are allowed, the applicant-writ petitioner shall file an amended writ petition with Chah Janajati Jatiya Sanmilani, Asom as party respondent no. 9 and by inserting Paragraph no. 10A and Prayer [‘f’] in the amended writ petition within 3 [three] working days from today.
