This is an application wherein petitioner is seeking liberty to surrender before the trial court against whom warrant of proclamation and warrant of attachment was issued vide order dated 23rd August, 2023. Petitioner earlier moved an application before this High Court in CRR 1362 of 2024 wherein liberty was given to him to surrender before the trial court within 4th May, 2024. However, the petitioner could not surrender before the court due to Parliament Election where he was acting as Booth President for a political party. Thereafter he made another prayer before this High Court in CRR 3215 of 2024 and again liberty was given to him vide order dated 25.09.2024 to surrender before the court below within seven days from the date of the order. However, the petitioner did not surrender because of alleged communication gap between the lawyer and the petitioner. Now petitioner again sought for granting liberty to surrender before the court below. Having heard learned counsel for the petitioner the service of copy of application upon the opposite parties is hereby dispensed with. 2 The instant application being CRR 57 of 2026 is hereby disposed of giving liberty to the petitioner as last chance to surrender before the court below within a period of seven days from date. If the petitioner surrenders before the court below within a period of seven days from date the learned court below shall dispose of his prayer in accordance with law, without being influenced by any observation made herein. In the event the petitioner fails to surrender before the learned Trial Court within the stipulated time frame, learned trial court shall be at liberty to take necessary steps against the petitioner, in accordance with law without further reference to this Court and the petitioner shall not be given same liberty by this High Court any further. The order dated 23rd August, 2023 by which warrant of proclamation and warrant of attachment was issued against the petitioner shall remain stayed for a period of seven days or until further order, whichever is earlier.
