This is an application filed under Section 482 of the BNSS, 2023 praying for granting of pre-arrest bail to the accused/ applicant in connection with Howly P.S. Case No. 108/2026, registered under Sections 318(4)/ 316(2)/ 61(2) of the BNS, 2023. 3. The allegation against the accused/ applicant is that accused/ applicant is involved in alleged irregularities by rice mill in milling the Govt. procured paddy under Barpeta district. 4. A co-ordinate Bench of this Court vide order dated 15.07.2026 has granted interim pre-arrest bail to the accused/ applicant with a direction to the accused/ applicant to appear before the I.O. within a week. 5. The learned senior counsel submits that in terms of the aforesaid direction in order dated 15.07.2026, the accused/ applicant has already appeared before the I.O. and his statement has been recorded. Therefore, he submits that the interim pre-arrest bail granted to the accused/ applicant should be made absolute. 6. Case diary in the instant case has been received and it is seen that accused/ applicant has already appeared before the I.O. 7. Taking into account the aforesaid, the interim pre-arrest bail granted vide order dated 15.07.2026 is made absolute and instant AB application is disposed of. 8. Taking into account the prayer made by the learned senior counsel as regards the interim pre-arrest bail condition mentioned in (iv) in order dated 15.07.2026 is modified to the following effect:- Page No.# 3/3 Accused/ applicant shall not leave the State without permission of the jurisdictional Magistrate.
