HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 16638 of 2026 Chief Justice's Court HON'BLE ARUN BHANSALI, CHIEF JUSTICE HON'BLE KSHITIJ SHAILENDRA, J.
1. The writ petition is directed against the order dated 10.11.2025 passed passed by Central Administrative Tribunal, Allahabad Bench, Allahabad in Original Application No. 1247 of 2024 ('the OA'), whereby the OA filed by the respondent has been allowed and the petitioners have been directed to ensure payment of pension and other post retiral benefits to the respondent treating him as regular appointee as Group-D employee with all consequential benefits. 2. Counsel for the petitioners fairly submits that the issue, as raised in the present petition, is squarely covered by the order dated 25.05.2026 passed in Union of India and 2 others Vs. Kalika Singh and another : 2026:AHC:120173-DB, whereby, after referring to the judgments and orders passed in similar matters, which were upheld upto Supreme Court, the writ petition has been dismissed. 3. In the case of Kalika Singh (supra), this Court, inter alia, observed as under:
“4. Based on the said submissions, the matter was adjourned from time to time by this Court. 5. Today, learned counsel for the respondents points out that in identical matters, arising from the judgements passed by this Court, Special Leave Petition (Civil) Diary No. 54252 of 2025: Union of India Vs. and others Vs. Nebboo Lal and other connected matters, special leave petitions have been dismissed on 12.01.2026 and following the said order in the case of Nebboo Lal, against the judgement in the case of Versus Counsel for Petitioner(s) : Vinay Kumar Singh Counsel for Respondent(s) : Ashish Kumar Srivastava Union of India and 3 others .....Petitioner(s) Shyam Sundar and another .....Respondent(s)
Harinandan (supra), the Special Leave Petition (Civil) Nos. 3073-3074 of 2025 has been dismissed by Hon'ble Supreme Court on 11.05.2026. 6. In view of the above fact situation, wherein the issue raised in the present petition is squarely covered by the judgement of this Court in the case of Harinandan (supra) and against the said judgement, special leave petition has been dismissed, we do not find any reason to entertain the present writ petitions against the orders passed by the Tribunal, the writ petitions are accordingly dismissed.”
4. In view of submissions made, the writ petition is dismissed following the order passed in Kalika Singh (supra).
