1. Applicant seeks regular bail in case arising out of FIR No. 0042/2026 dated 25.03.2026, registered at P.S. Chankya Puri for commission of offences under Sections 351(2) of Bharatiya Nyaya Sanhita, 2023 (corresponding Section 506 IPC) and Section 6/8 of Protection of Children From Sexual Offence Act, 2012

The abovesaid FIR was registered on the basis of PCR call made by the mother of the victim boy, who apprised that the applicant, herein, had made forceful physical relationship with her minor son. 3. The copy of FIR is on record which has been perused. 4. Charge-sheet has already been filed which also contains the statement made by the victim-boy under Section 183 of Bharatiya Nagarik Suraksha This is a digitally signed order. Sanhita (corresponding Section 164 Cr.P.C.). 5. As per the Nominal Roll received from the jail, the applicant is only 20 years of age and is in custody for more than three and half months. She has no prior involvement of any nature whatsoever and her jail conduct is found to be satisfactory. 6. When the present application was taken up by this Court on the last date of hearing, the prosecutor was directed to get in touch with the family of the victim, so that their response, if any, is also duly regarded. 7. The victim boy and his mother have joined the proceedings through video-conferencing and they have been duly identified by I.O. When asked, the mother of the victim boy stated that she would have no objection to the grant of bail, provided the applicant is directed to resist from any such act or endeavour in future. 8.
During course of the arguments, learned counsel for the applicant, on instructions from the mother of the applicant who is present in Court, submits that the applicant would maintain complete distance from the family of the complainant and would also shift from his existing residence. 9. Keeping in mind the overall facts and circumstances, albeit, without expressing any opinion over the merits of the case, applicant is hereby admitted to bail on his furnishing personal bond in a sum of Rs. 10,000/- with surety of like amount, subject to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Judicial Magistrate First Class with the following conditions:- a. Surety would be local. b. Applicant shall appear before the learned Trial Court regularly on date(s) fixed. c. Applicant/accused shall not come in contact of any witness, This is a digitally signed order.
