This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 282/2025 registered at Police Station – Outpost Karanji P.S. Bishrampur District Surajpur (C.G.) for the offence punishable under Section 318(4) of the BNS.
2. The prosecution story in brief, is that the complainant Mohd. Ibrahim filed written complaint on 04.08.2025 stated that in month of October, 2024 the present applicant told him to he has double the amount only VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2026.01.07 11:00:27 +0530
2 in 9 days and on 13.10.2024 complainant gave some of Rs. 50,000/- through Phonepe and Rs. 3,00,000/- in cash to the present applicant in the present of witnesses namely Mohd. Imran and Mohd. Sabir. That after the completion of 90 days the complainant asked to returned the amount but the present applicant not do the same. That, on the basis of complaint dated 04.08.2025 FIR No. 282/2025 was registered against the present applicant.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case and there is an unexplained delay of more than one year in lodging the FIR, which itself casts a serious doubt on the veracity of the prosecution story. It is further submitted that the applicant had already moved a written complaint before the Superintendent of Police, Surajpur on 17.11.2025 against the complainant, a copy whereof is filed as Annexure A/3, which clearly shows that the present case is a counterblast to the said complaint. The dispute between the parties is purely civil in nature, but the complainant has deliberately given it a criminal colour with mala fide intention. The applicant is a permanent resident of the aforesaid place, possesses both movable and immovable properties there, and there is no likelihood of his absconding or tampering with the prosecution witnesses. The applicant is ready and willing to furnish adequate security and undertakes to abide by all the terms, conditions and directions that may be imposed by this Hon’ble Court while granting bail., therefore, he prays grant of bail to the applicant on the ground of parity. 4. On the other hand, the learned State counsel opposes the bail application of the applicant. 3
5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, the submissions of the learned counsel for the parties, the nature of the dispute, and the material available in the case diary, this Court, without expressing any opinion on the merits, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Abdul Rauf, on executing a personal bond and one local surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial.
(c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
