2. The present petition has been filed by the petitioner with the following prayers:
“a. Allow the present petition and quash the impugned FIR No. 02 of 2026 dated 01.01.2026 registered at Police Station Pachpedi, District Bilaspur under Section 299 of the Bharatiya Nyaya Sanhita, 2023, and all proceedings arising therefrom, including any charge-sheet if filed in the interest of justice; b. Quash the entire criminal proceedings initiated against the petitioner pursuant to the aforesaid impugned FIR, as the same is manifestly mala fide, abuse of process of law, and violative of the petitioner’s fundamental rights guaranteed under Articles 14, 21, and 25 of the Constitution of India; c. Direct the respondent No. 1 (State of Chhattisgarh) and its police authorities not to harass or interfere with the petitioner’s right to peacefully profess, practice and propagate his Christian faith, including conducting prayer meetings and religious gatherings at his residence, in view of the law laid down by this Hon’ble Court in Badri Prasad Sahu & Anr. vs. State of Chhattisgarh WPC No. 1281 of 2026 (decided on 24.03.2026) and d. Grant any other relief(s) as this Hon’ble Court may
3 deem fit and proper in the facts and circumstances of the case, including the cost of this petition.”
3. Learned State counsel submits that, in the present case, the charge-sheet has already been filed before the learned trial Court.
In response, learned counsel for the petitioner prays that the present petition be dismissed as withdrawn, with liberty to avail appropriate remedy in accordance with law. 4. Prayer is allowed. 5. Accordingly, in view of the submission made by learned counsel for the petitioner, the present petition is dismissed as withdrawn, with liberty to the petitioner to take recourse to such remedy as may be available to him in law before the appropriate forum. 6. Certified copy of the FIR and other documents, if any, filed by the petitioner, be returned to him after retaining photocopies thereof on record.
