PUBLIC PROSECUTOR 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 2990/2026 ORDER:- The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the petitioner/Accused, for granting of pre-arrest bail in connection with Crime No.58/2026 on the file of Cyber Crime Police Station Visakhapatnam, registered for the offences punishable under Sections 118(1),316(4),318(4) r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’). 2. Heard Sri Chatrati Radha Krishna, learned counsel for the petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor for the State. Perused the record. 4. When the matter is taken up for hearing, learned Assistant Public Prosecutor would submit that they have already issued notice under Section 35(3) of the BNSS., in this matter. Despite the same, they did not choose to appear. 5. Learned counsel for the petitioner would submit that an opportunity may be given to the petitioner to appear before the police and cooperate with the investigation. 6. Recording the above submissions, the Criminal Petition is disposed of with the following: 3 a. The petitioner is at liberty to appear before the Investigating Officer in pursuance of the notice issued under Section 35(3) of the BNSS and cooperate with the investigation. b. The petitioner shall furnish all relevant information and material documents, if any, to the Investigating Officer for the purpose of investigation. c. The Investigating Officer is directed to follow the procedure contemplated under Section 35(3) of the BNSS and the guidelines of the Hon’ble Apex Court in Arnesh Kumar v. State of Bihar 1 in accordance with law.
