Public Prosecutor, Assam, appearing for the State respondent. This is an application under Section 483 of the BNSS, 2023 for granting regular bail to the petitioner, namely, Nabajyoti Ray, in connection with Gossaigaon P.S. Case No. 169/2026, under Sections 69/ 74/ 115(1)/ Page No.# 2/2 351(2)/ 3(5) of the BNS, 2023 read with Section 4 of the Dowry Prohibition Act, 1961. The allegation as reflected in the FIR involves entering into physical relationship on the basis of the promise on the part of the petitioner to marry the victim. It appears that subsequently some difficulty and dispute arose as the petitioner and the victim belonged to different communities. The allegation of assault and demand of dowry has also made. It appears that subsequently some sort of compromise was also recorded between the parties wherein they have been described as husband and wife. The petitioner was arrested on 02.08.2026. Having regard to the above, it appears that further custodial detention of the petitioner may not be necessary. Accordingly, the petitioner named above be released on bail on furnishing a bond of 50,000/- with two sureties of the like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Gossaigaon, subject to the conditions that the petitioner shall participate the trial of the case as and when one commences and shell not harass the informant/ victim in any manner.
