1. By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks the following reliefs:
“a) Call for the records of the proceedings from Family Court of Sh. Ajay Singh Shekhawat, Judge, Family Court -01, North East, Karkardooma Courts, Delhi in maintenance petition no. 575/2021 under section 125 Cr.PC. for the purpose of revision. b) Set aside or modify the impugned order dated 10.02.2026 passed by the Learned Principal Judge, Family Court, Sh. Ajay Singh Shekhawat Judge, Family Court -01, North East, Karkardooma Courts, Delhi, to the extent of reducing or cancelling the maintenance payable by the Revision Petitioner. c) Allow the revision petitioner to lead the respondent evidence thereby directing the Hon’ble Trial Court to record the respondent evidence in the present case. 2. At the outset, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to approach this Court if, as and when required, since an appropriate application has already been moved before the learned Family Court which is pending.
3. As such, the present petition, alongwith the pending applications, is dismissed as withdrawn with liberty as prayed for.
