Accused is before this Court in this criminal revision petition filed under Sections 397 read with 401 of Cr.PC with a prayer to set aside the judgment and order of conviction and sentence dated 01.01.2016 passed in CC.No.14465/2012 by the Court of XXII Addl. Chief Metropolitan Magistrate, Bengaluru, and the judgment and order dated 20.08.2016 passed by the Court of LXV Addl. City Civil & Sessions Judge, Bengaluru, in Crl.A.No.75/2016. 2. Learned Counsel for the parties jointly submit that the dispute between the parties has been amicably settled during the pendency of the petition and the respondent- complainant has agreed to receive a total sum of Rs.2,55,000/- from the petitioner towards full and final settlement of the dispute between them. They submit that a joint memo is filed before this Court reporting settlement and out of the agreed amount towards settlement, an amount of Rs.1,30,000/- shall be forthwith deposited by - 3 - HC-KAR NC: 2026:KHC:11841 CRL.RP No. 1130 of 2016 the petitioner before the Registry of this Court. They submit that the balance amount of Rs.1,25,000/- has been already deposited by the petitioner before the Trial Court in CC.No.14465/2012. 3. The aforesaid submissions and the joint memo filed by the parties is taken on record. 4. Criminal revision petition is allowed in terms of the settlement arrived between the parties and consequently, the impugned judgment and order of conviction and sentence dated 01.01.2016 passed in CC.No.14465/2012 by the Court of XXII Addl. Chief Metropolitan Magistrate, Bengaluru, and the judgment and order dated 20.08.2016 passed by the Court of LXV Addl. City Civil & Sessions Judge, Bengaluru, in Crl.A.No.75/2016, are set aside. Petitioner is acquitted for the offence punishable under Section 138 of the N.I.Act. His bail bonds, if any, stands cancelled. Respondent-complainant is permitted to withdraw the amount of Rs.1,25,000/- deposited before - 4 - HC-KAR NC: 2026:KHC:11841 CRL.RP No. 1130 of 2016 the Trial Court and also the amount of Rs.1,30,000/- deposited by the petitioner before the Registry of this Court.
