2. The present petition has been filed by the petitioners with the following prayers:
“10.1 That, this Hon’ble Court may kindly be pleased to call for entire records pertaining to the case of the petitioners from Police Station – Odgi, District – Surguja (C.G.). 10.2 That, this Hon’ble Court may kindly be pleased to allow this instant petition and consequentially quash the FIR bearing No. 18 of 2025 registered at Police Station – Odgi, District Surajpur (C.G.) on dated 15.05.2025, for offence punishable under Section 85, 3(5) of Bharatiya Nyaya Sanhita, 2023, further quash charge-sheet (Challan) bearing No. 12 of 2025 dated 29.05.2025 (Annexure P/1) for offence punishable under Section 85, 3(5) of Bharatiya Nyaya Sanhita, 2023 and also quash the order taking cognizance dated 05.07.2025 registering a criminal case No. 3318 of 2025 as well as the entire proceedings of the criminal case No. 3381 of 2025 which is pending before the learned Judicial Magistrate First Class, Surajpur, District Surajpur (C.G.) against the petitioner pursuant to the aforesaid charge-sheet, in the interest of justice. 10.3 That, any other relief/order which may deem fit and just in the facts and circumstances of the case, in the interest of justice.”
3. Learned State Counsel submits that the present petition is not maintainable, as the husband of the complainant/respondent No. 2 has not been arrayed as a petitioner.
4. On a pointed query being put by this Court to the learned counsel
3 for the petitioners as to why the husband of the complainant/respondent No. 2 has not been arrayed as a petitioner, despite the FIR having been lodged against the husband, father-in-law (petitioner No. 1) and brother- in-law (petitioner No. 2), learned counsel for the petitioners submits that the husband of the complainant/respondent No. 2 does not reside with the petitioners.
5. This Court is not satisfied with the explanation offered by the
learned counsel for the petitioners.
6. Consequently, learned counsel for the petitioners seeks permission of this Court to withdraw the present petition with liberty to file a fresh petition after arraying the husband as a petitioner.
7. In view of the submission made by the learned counsel for the petitioners, the present petition is dismissed as withdrawn with liberty as prayed for.
