Usha Raghav v. The H.P. Gramin Bank & Ors. CMP No.4321 of 2026 in Ex. Petition No.2413 of 2025 18.06.2026 Present: Mr. Jagat Pal, Advocate, for the applicant/petitioner. Mr. K.B. Khajuria, Advocate, for the non- applicants/respondents. Learned counsel for the applicant/petitioner submits that though now the family pension has been released in favour of the petitioner as from the date of death of her husband, but, the petitioner has not been released the pension, to which, the late husband of the petitioner was entitled to, as from the date, when he was compulsorily retired, till the date of his death. Learned counsel submits that this relief was there in the earlier writ filed by the petitioner, which was disposed of on 05.09.2025, in the light of the statement made on behalf of the Bank that the case for the grant of pension was being considered by the employer. This Court has perused the pleadings of CWP No.12997 of 2025, which demonstrates that the petitioner therein had prayed for the grant of pension from the month of March, 2023 onwards, though, it appears that erroneously, the word ‘family pension’ was used and, therefore, as the earlier petition was disposed on the holding out of the Bank that they were considering the case of the petitioner and now as the petitioner has only been paid family pension as from the date of her husband w.e.f. 10.11.2023, these proceedings are closed with liberty to the petitioner to approach the Court afresh with regard to the non-release of the pension payable to her late husband, if so advised.
