2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioners, namely, Mahbubul Islam and Asif Ahmed @ Arif Ahmed, praying for grant of bail who is in custody since 22.07.2026 in
Page No.# 2/2 connection with Dudhboi P.S. Case No.41/2026 under Sections 318(3)/318(4)/61(2)(a)/112/56 of BNS, R/W Section 66(B)/66(C) of POCSO Act.
3. According to the FIR lodged by a student, the accused No.1 named in the FIR had sought his permission to use his bank account since one of the friend of the accused No.1 was having a KYC problem. It later appeared that the bank account of the informant had been used for making fraudulent transactions and the account of the student had been blocked by the National Cyber Crime Reporting Portal. The accused No. 2 and accused No. 3 in the FIR are before this court praying for grant of regular bail.
4. The learned counsel for the petitioner has submitted that the petitioners are not involved in this process and therefore, they may be enlarged on bail.
5. Learned Additional Public Prosecutor has submitted that the investigation so far, as revealed in the case dairy have implicated the present petitioners and there are sufficient materials against the present petitioners to indicate that they were the persons who were responsible for the fraudulent transaction, etc.
6. I have heard the learned counsel for the parties and I have also considered the contents of the case diary.
7. At this stage, I am not inclined to grant bail to the petitioners. Accordingly, the bail application is dismissed.
