D/L3 24.03.2026 Bpg. Disposed of C.R.M. (NDPS) 364 of 2026 In Re: An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Hili Police Station Case No.138 of 2025 dated 28.06.2025 under Sections 21(c)/22(c)/23(c)/27(A)/28 of the NDPS Act, 1985 read with Section 46A(c) of Bengal Excise Act; Chandan Majumder Versus The State of West Bengal Mr. Koushik Choudhury Mr. Dwaipayan Panda. …for the petitioner. Mr. Avishek Sinha Ms. Sana Naaz. …for the State. Learned advocate appearing for the petitioner submits that 1990 ampules of buprenorphine were recovered from an accused and the petitioner has been arrested on the basis of the statement of co-accused and is in custody for 2 months 24 days. The investigation has already been concluded, charge-sheet has been submitted and charges have also been framed, as such, on any stringent conditions, the petitioner may be released on bail. Learned advocate for the State submits that the seizure was effected on 28th June, 2025 and the call data records reflect that 29 calls were found between the present petitioner and the accused from whom seizure has been made. Having considered the quantity of contraband recovered, I direct the learned trial court to prepone the evidence of the seizure 2 list witnesses. Learned special court would after the seizure list witnesses are over, on an application for bail filed by the petitioner, if it inspires confidence, it will decide the bail application by exercising its discretion. However, in case there is no substantial evidence from the seizure list witnesses, in that case, the learned special court will release the petitioner on bail on such terms and conditions as he deems fit and proper for ensuring further participation in the trial. With the aforesaid observations, CRM(NDPS)364 of 2026 is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
