The petitioner is an accused in connection with Bagodar P.S. Case No. 49/2024. It has been alleged that the son of the informant was waylaid by the miscreants and shot at his abdomen. During course of treatment, the son of the informant had died. Submission has been advanced by learned counsel for the petitioner that there are no eye witnesses to the incident. It has been submitted that co-accused Bicky Saw has been granted bail in B.A. No. 1928 of 2025. Learned A.P.P. has opposed the prayer for bail of the petitioner and has submitted that the wife of the deceased has stated about the disclosure made by the deceased prior to his death with respect to the involvement of Bicky and the petitioner in firing at him. However, it appears that Bicky Saw has been granted bail as noted above. It further appears that though the incident had taken place on 05.04.2024 and the deceased had died on 21.05.2024, but there is nothing on record to indicate that the dying declaration of the deceased was ever recorded. On consideration of the aforesaid facts, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the Neutral Citation 2026:JHHC:8014 like amount each to the satisfaction of learned Additional Sessions Judge-IV, Giridih in connection with Bagodar P.S.
