Mr. Chander Shekhar Thakur, Advocate, for the proposed applicants/respondents. CMP No.14032/2026 & CMP(M) No.939/2026 The present applications under Order 1, Rule 10, read with order 22, Rule 9 of CPC and Section 5 of the Limitation Act have been filed by the applicants/proposed respondents for impleading them as party in the present appeal. 2. As per the applicants, respondent No.2, Shyam Lal, has expired on 24.10.2025 and left behind them as his legal heirs. However, delay in filing the application has occurred as the fact of death of respondents No.2 was not in the knowledge of the counsel for the respondents and it was only in the second week of April, 2026 when the applicants approached the counsel for release of the balance amount of compensation and informed about the death of respondent No.2. Therefore, the delay, as occurred, is neither intentional nor willful, but was beyond the control of the applicants, as such, the same deserves to be condoned. The applications are duly supported with the affidavit of one of the applicants, namely Jai Singh, as well as copy of death certificate of the deceased and legal heirs certificate. 3. No reply(ies) to the applications is/are intended to be filed and the learned Additional Advocate General for the non-applicants has no objection in case the present applications are allowed. 4. Heard. Having regard to the averments made in the applications, the same are allowed and the applicants, as mentioned in para-3 of the application (CMP No.14032/2026), are impleaded as party respondents in the main appeal, being legal representatives of deceased respondent No.2-Shyam Lal and they shall figure as respondent No.2(I) to 2(V) in the array of respondents. Amended memo of parties, filed alongwith the applications, is ordered to be taken on record. 5. The applications stand disposed of. CMP No.14034 of 2026 Learned Additional Advocate General prays for and is granted two weeks’ time to seek instructions in the matter. List thereafter.
