[2026:RJ-JP:30232] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 11787/2026 CNR: RJHC020709082026 | URN: CRLMB / 21706U / 2026 Abdul Vasit @ Vasid S/o Abdul Majid, Aged About 49 Years, Resident Of Eidgah Road Ward No. 33, Towan Jhunjhunu Police Station Kotwali, District Jhunjhunu. At present confined in Central Jail Jhunjhunu ( Rajasthan) ----Petitioner Versus The State of Rajasthan, through P.P. ----Respondent For Petitioner(s) : Mr. Frooq Ahmed Mr. Toshif Ahmed For Respondent(s) : Mr. Jai Prakash Tiwari, P.P. Mr. Hidayat Ali, Police Station – Kotwali, District Jhunjhunu, I.O., present in person Mr. Ashvin Garg, for the complainant HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 04/08/2026 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.217/2025 registered at Police Station Kotwali Jhunjhunu, District Jhunjhunu for offences under Sections 318(4), 316(2), 336(3) and 61(2) of BNS, 2023. 2. Heard learned counsel for the petitioner, learned Public Prosecutor as well as counsel for the complainant and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the petitioner and complainant both are belonging to the same [2026:RJ-JP:30232] (2 of 3) [CRLMB-11787/2026] family. He further contends that there are two agreements related to the disputed property in which both the parties are joint owners. He again contends that the matter is purely civil in nature which has been given colour of criminal flavour. Petitioner is behind the bars since 09.07.2026, without any criminal antecedents. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, consequently, the bail application deserves to be allowed. 4. Learned Public Prosecutor and counsel for the complainant have vehemently opposed the bail application. It is submitted by learned counsel for the complainant that no consideration has been deposited for the above agreements. He also submits that forged documents have been submitted by the petitioner to grab the disputed property, therefore, the petitioner is not entitled to be granted benefit of bail. 5. Learned Public Prosecutor along with Investigating Officer, who is present in pursuance of the earlier order of this Court, have submitted that the matter pertains to property in which both parties are co-owner. He further submits that the FSL report is yet to be received. 6. On consideration of the rival submissions and material available on record and in light of submissions made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 7. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Abdul [2026:RJ-JP:30232] (3 of 3) [CRLMB-11787/2026] Vasit @ Vasid S/o Abdul Majid, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
