ORAL ORDER
The petitioners are before this Court seeking the following prayer:
"WHEREFORE, the above named Petitioner most humbly prays that this Hon'ble court be pleased to quash the FIR (Annexure-A) in Crime No.0066/2025 (DK CEN Crime Police) pending on the file of PRINCIPAL CIVIL JUDGE AND JMFC BELTHANGADY, DAKSHINA KANNADA DISTRICT for the alleged offences punishable u/s against the Petitioner, in the interests of justice and equity."
2. Heard Sri.Goutham M, learned counsel appearing for the petitioners, Sri.B.N.Jagadeesha, learned Addl. SPP appearing for respondent No.1, Miss. Kannika learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Joint Memo in that regard. The Joint Memo reads as follows:

“JOINT MEMO 1.The Undersigned counsel for the Petitioners and Respondent submits that the Petitioner's and Respondents have arrived foramicable settlement. In view of the amicable settlement the petitioners have agreed to pay sum of Rs. 8,75,000/- ( Rupees Eight Lakhs Seventy Five Thousand). Out of 8,75,000/- (Rupees Eight Lakhs Seventy Five Thousand) the petitioners are hereby paying the sum of Rs. 500000/- ( Rupees Five Lakhs only) to the Respondent No.2/ De-facto complainant by way of DD & Cheque as stated below. METHOD OF PAYMENT:
1. Rs. 1,50000/- (Rupees One lakh fifty thousand) through cheque bearing No. 649116 Account No. 01342200160961, IFSC: CNRB0000517, Canara Bank. Madikeri Main, Madikeri-571201-by the Abdul Azeem (Petitioner No.1)
2. Rs. 1,25000/- (Rupees One lakh twenty five thousand) through cheque bearing Cheque No.649117. Account No. 01342200160961, IFSC: CNRB0000517, Canara Bank, Madikeri Main, Madikeri- 571201- by the Abdul Azeem (Petitioner No.1)
3. Rs. 2,00,000/- (Rupees Two lakh) through DD bearing No. 595859, Account No. 102483004245, IFSC: CNRB0010248, Canara Bank, Puttur Campco Chocolate Factory Branch, Puttur-574202- by the Sharuk Ibrahim (Petitioner No.2)
4. Rs. 25,000/- (Rupees Twenty Five thousand through DD Bearing No. 988727. Account No. 70820100006118, Bank of Baroda. DarbePuttur Branch, Konkan Trade Centre, Darbe-574202- by the Munaz (Petitioner No.3)

The remaining amount for a sum of Rs.3,75,000/- (Rupees Three lakhs Seventy Five Thousand Only) will be paid to the de-facto complainant after defreezing of the

accounts belonging to the petitioner's and accordingly the petitioners pleased to pass an order of defreeze the accounts of the petitioner's and direct the same to the Respondent police. 3.In view of the above the petitioner's prays that this Hon'ble court be pleased to quash the proceedings/ Investigation in Crime No. 0066/2025 registered by the Respondent Police in the interest of Justice. Hence this Joint memo may be taken on record in the interest of justice.”

Learned counsel for the petitioners hands over demand draft and the cheque. The cheque is handed over for the reason that the account is frozen.
5. In the light of Joint Memo, application for defreezing the account being filed along with the affidavit, and offences not being against the State, I deem it appropriate to accept the Joint Memo and the application for defreezing the account and terminate the proceedings against the petitioners in the subject petition.
6. For the aforesaid reasons, the following:
ORDER i. Criminal Petition is disposed.

ii. Proceedings/investigation in FIR (Annexure- A) in Crime No.0066/2025 (DK CEN Crime Police) pending on the file of Principal Civil Judge and JMFC Belthangady, Dakshina Kannada District, stands quashed qua the petitioners.
iii. In the light of the settlement and the quashment of the proceedings, learned Addl. SPP shall instruct the Investigating Officer to forthwith communicate to the bank to defreeze the account to enable clearance of the cheque.
Ordered accordingly.
