Mr. S.P. Kale would submit that the claim of the petitioner for regularization has been rejected by the respondent authorities on the ground that the petitioner did not complete 10 years of regular service under the respondents. He would refer Annexure P/7 dated 29.10.2016 issued by Sub-Divisional Officer, Public Works Department and Service book (Annexure P/8) which show that the petitioner was appointed in the year 1995 and he worked for more than 14 years under the respondents. He would submit that respondent No. 2 has not considered those documents and passed order Annexure P/1. He would pray to set-aside order dated 17.02.2022. 3. On the other hand, learned counsel for the State would oppose. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. Annexure P/7 dated 29.10.2016, clearly manifests that the petitioner was appointed in the year 1995 and he continuously worked for a period of 14 years. The Chief Engineer, Public Works Department, Raipur has not considered documents dated 29.10.2016 (Annexure P/7) and Service Book (Annexure P/8), therefore, the order Annexure P/1 dated 17.02.2022 is hereby set-aside. The matter is remitted back to the Chief Engineer, Public Works Department to consider the claim of the petitioner for regularization afresh preferably within a period of 120 days strictly in accordance with the law. The authority concerned shall consider documents Annexure P/7 dated 29.10.2016 and service book (Annexure P/8) while taking decision. 3 6. Accordingly, this petition is hereby allowed.
