Ms. Sananda Bhattacharyya …for the Petitioner The petitioner herein is aggrieved with the order dated 9th March, 2021 by which the court below had issued warrant of arrest against the present petitioner. Being aggrieved by the aforesaid proceeding, learned counsel for the petitioner submits that the petitioner now wants to surrender before the court below and he may be given liberty. Having heard learned counsel for the petitioner and that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made by the petitioner, the opposite party will have no cause to prejudice, the service of copy of the application upon the opposite party are dispensed with. In view of the aforesaid submission made on behalf of petitioner, CRR 204 of 2026 is hereby disposed of giving liberty to the petitioner to surrender before the court below within a period of four weeks from the date of communication of the order and in the event such surrender, the court below will dispose of his prayer in accordance with law without being influenced by any observations made herein. 2 The impugned order dated 9th March, 2021, which pertains to the issuance of warrant of arrest against the petitioner, is hereby stayed for a period of four weeks or till the petitioner surrenders before the court below, whichever is earlier.
