2. The petitioner is apprehending his arrest in connection with Rehla P.S. Case No.86 of 2025 for the alleged offences registered under Sections 103(1), 123 and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Chief Judicial Magistrate, Palamau.

Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case only considering that the petitioner and deceased were in relationship. He further submits that the liquor was purchased from co-accused Surendra Yadav, however, only on the statement that the said liquor was taken at the house of the petitioner, she has been implicated in this case. On these grounds, he submits that anticipatory bail may kindly be granted.

Learned counsel appearing for the State opposed the prayer and submits that at home the deceased has informed the family members that he has taken liquor in the house of this petitioner and the deceased

was in relationship with the petitioner. On this ground, she submits that anticipatory bail may kindly be rejected.
5. Considering that the said liquor was purchased by deceased from one Surendra Yadav, however, he has informed that he has taken the said liquor in the house of the petitioner. Independent witnesses in the case diary have stated that they have not seen the deceased in their area on the fateful day. Admittedly, the liquor was taken from one Surendra Yadav and the witnesses have not seen the deceased on that day in the area and that has come in the diary. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Palamau in connection with Rehla P.S. Case No.86 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
