This is an application filed under Section 5 of the Limitation Act, 1963 for condonation of delay of 7 days in filing the connected criminal appeal under Section 415 of the BNSS, 2023 against the judgment and order dated 08.05.2026 passed by the learned Special Judge, Jorhat in Special Case No. 235/2022 arising out of GR Case No. 1304/2022 in Jorhat P.S. Case No. 838/2022. 3. Office note dated 12.08.2026 reveals that service of notice on respondent No.2 has already been completed. However, no one appeared for the respondent No.2 when the matter was called for. 4. On perusal of the explanation given for the delay in filing the connected criminal appeal in the instant interlocutory application, this Court is of the considered opinion that the delay of 7 days in filing connected criminal appeal should be condoned. Accordingly, the delay is hereby condoned. 5. Registry to register the connected criminal appeal and list the same for admission on 24.09.2026. 6. Interlocutory application stands disposed of.
