JUSTICE ROBIN PHUKAN ORDER 14.08.2026 Heard Ms. B. Sarma, learned counsel for the applicant and Mr. P. Barthakur, learned Additional Public Prosecutor for sole opposite party. 2. This petition, under Section 430 of the BNSS, 2023, is preferred by the applicant to allow him to go on fresh bail. 3. Ms. Sarma, learned counsel for the applicant submits that the applicant has preferred one Revision Petition, against the impugned Judgment and Order, dated 10.02.2026, passed by the learned Sessions Judge, Golaghat, in Criminal Appeal No. 06/2021; whereby, the applicant was convicted under Sections 326/448 IPC and sentenced to suffer rigorous imprisonment for 3 years and to pay a fine of Rs. 5000/-, with default stipulation, under Section 326 IPC; and was also sentenced to suffer rigorous imprisonment for 3 months and to pay a fine of Rs. 500 with default stipulation, under Section 448 IPC. 3.1. Ms. Sarma further submits that in the connected Revision petition, the Page No.# 3/3 record has already been call for and there is a requirement for allowing the applicant herein to go on fresh bail. 4. Accordingly, taking note of the submission of the learned counsel for both the parties and also considering the fact that the applicant has been convicted only for a period of 3 years, this Court is inclined to allow this application. 5. It is provided that on furnishing a bond of Rs. 20,000/- with one surety of like amount, to the satisfaction of the learned Sessions Judge, Golaghat, the applicant shall be enlarged on bail. 6.
