CORAM: HON'BLE MR. JUSTICE SACHIN SHANKAR MAGADUM
ORAL ORDER The present writ petition is filed invoking the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India, seeking issuance of a writ in the nature of mandamus directing respondent No.1 to transfer the investigation in Crime No.275/2024 to respondent No.9 – the Criminal Investigation Department (CID).

2. When the matter was taken up for consideration, learned Additional Government Advocate, on instructions, submits that the investigation in the subject crime has already been concluded by the jurisdictional Investigating Officer and a final report/charge sheet has been laid before the competent jurisdictional Court. It is further submitted that the said charge sheet has been taken on file by the jurisdictional Magistrate and the proceedings are now seized of by the trial Court.
3. In view of the subsequent development, namely completion of investigation and filing of charge sheet, the principal relief sought in the present writ petition, which is for transfer of investigation, does not survive for
consideration. Once the investigation has culminated in filing of a final report, the question of transferring investigation to another agency at this stage does not arise, and the writ petition, to that extent, is rendered infructuous.

4. Accordingly, this Court is of the considered opinion that no further adjudication is warranted in the present writ petition. The writ petition stands dismissed as having become infructuous.
