OMP(M) No. 32 of 2026 The instant application has been filed by the applicant for condonation of delay of 369 days in filing the present appeal. It has been averred in the application that the impugned judgment was passed by learned District Judge, Mandi on 01.08.2024. It has further been averred that the appellant had applied for a certified copy of the impugned judgment dated 01.08.2024 on 02.08.2024. The said certified copy was prepared and delivered on 09.09.2024. It has been averred that due to inadvertence and oversight, the certified copy was misplaced and could not be traced despite best efforts. Thus, the misplacement of the certified copy was neither deliberate nor intentional but occurred due to unavoidable circumstances. Upon retrieval of the certified copy after diligent search, the appellant immediately took all necessary steps for preparation and filing of the present appeal without any further delay. Therefore, it has been prayed that the delay in filing the appeal is neither intentional nor willful, but the same has occurred due to unavoidable circumstances. Notice in the aforesaid application was issued for the service of sole respondent on 05.03.2026. As per report of the Registry, sole respondent stood duly served. Though, Ms. Anita Kumari, Advocate, had put in appearance before the Additional Registrar (Judicial) on 24.04.2026, however, today, none has put in appearance on behalf of the sole respondent. Consequently, in view of the averments as made in the application, which is duly supported by an affidavit and in view of the submissions as made by learned counsel for the applicant, the present application is allowed and delay in filing the appeal is condoned.
