1. Heard learned Counsel Mr. D.K.Baidya for the accused applicant and Mr. R.J. Baruah, learned Addl.Public Prosecutor for the respondent State.
2. This is an application filed under Section 482 of the BNSS, 2023, praying
Page No.# 2/3 for grant of pre-arrest bail to the accused-applicant apprehending arrest in connection with Dispur P.S. Case No. 420/2026, registered under Sections 329(4)/74/115(2)/351(3) of the BNS, 2023.
3. The allegation as made in the FIR is that the accused applicant entered into the house of the informant and physically assaulted the informant’s family members and as a result of which, the mother-in-law of the informant sustained injury on her neck and arm. On receipt of the FIR, police registered Dispur P.S. Case No. 420/2026 under the aforementioned Sections.
4. A co-ordinate Bench of this Court by order dated 26.06.2026 has granted interim pre-arrest bail to the accused applicant to appear before the investigating officer within 10 days.
4. The learned counsel of the accused applicant submits that in terms of the
order dated 26.06.2026, the accused applicant has already appeared before the investigating officer and his statement has already been recorded. He submits that in view of the aforesaid, the interim pre-arrest bail should be made absolute.
5. Case Dairy is received and the same is perused.
6. Taking into account that the accused applicant has appeared before the investigating officer and his statement has already been recorded, this Court is of the considered opinion that interim pre-arrest bail granted to the accused- applicant vide order dated 26.06.2026 should be made absolute.
7. Accordingly, the interim pre-arrest bail granted to the accused-applicant vide order dated 26.06.2026 is hereby made absolute in the same terms and conditions as stated in the order dated 26.06.2026.
8. The anticipatory bail application is disposed of.
