B E F O R E HON’BLE MR. JUSTICE DEVASHIS BARUAH ORDER 12.08.2026 Heard Mr. S Borthakur, the learned Senior Counsel assisted by Mr. US Bora, the learned counsel appearing on behalf of the petitioner. Also heard Ms. MD Bora, the learned Standing Counsel, Transport Department, Govt. of Assam. 2. The present writ petition has been filed by the petitioner Association challenging the action on the part of the respondent authorities in not permitting the EV Autos to ply within the Dibrugarh Municipal Corporation and were only permitted to run within certain specified routes. 3. It is seen that during the pendency of the instant writ petition, an order dated 26.06.2026 has been passed by the Chairman, DRSC-cum- District Commissioner, Dibrugarh whereby those EV Autos whose registered address fall within the Dibrugarh Municipal Corporation and 5 KM radius of the Dibrugarh Municipal Corporation boundary shall be permitted to operate within the jurisdiction of the Dibrugarh Municipal Corporation and Assam Medical College Hospital area. Page No.# 3/3 4. In view of the above, the cause of action for which the present writ petition was filed has been substantially altered. 5. The said order dated 26.06.2026 placed before this Court by Ms. MD Bora, the learned Standing Counsel, Transport Department is kept on record and marked with the letter ‘X’ 6. Mr. S Borthakur, the learned Senior Counsel appearing on behalf of the petitioner Association submits on instruction(s) that the petitioners would be well advised to withdraw the instant writ petition and if necessary challenge the order dated 26.06.2026. 7. Taking into account the above, the instant writ petition stands closed on withdrawal. 8. Liberty, however, is granted to the petitioner or any member of the petitioner Association to assail the order dated 26.06.2026 passed by the Chairman, DRSC-cum- District Commissioner, Dibrugarh, if so permissible under the law.
