The joint memo reads as under. "1. The revision petitioner was the accused and the respondent was the complainant before the trial and appellate courts. Parties are referred to as per their respective status before the lower court for the sake of convenience. 2. The above complaint is filed against the accused for an offence which is punishable under Section 138 of Negotiable Instruments Act for the dishonour of cheque issued for Rs.6,55,000/- (Rupees Six Lakhs and Fifty Five Thousand). 3. During the pendency of the above petition both the parties agreed to settle the amount for Rs.4,50,000/- in the place of Rs.6,55,000/- and filed joint memo dated 15.12.2025 before the magistrate court as per the following terms:- a) Both parties agree that complainant is entitled to get an amount of Rs.4,50,000/- (Rupees Four Lakhs Fifty - 3 - HC-KAR NC: 2026:KHC:14477 CRL.RP No. 1693 of 2025 Thousand only) in the place of Rs.6,55,000/-. Out of which an amount of Rs.3,00,000/- (Rupees Three Lakhs) was paid in cash to the accused on 15.12.2025 before the magistrate. b) The accused has also deposited an amount of Rs.1,31,000/- (Rupees One Lakh and Thirty One thousand only) before the Magistrate court at the time of obtaining stay in Sessions Court. The said amount is deposited before the trial court and due to the present settlement the accused have no objection from his side for release of the said amount of Rs.1,31,000/- in favour of the complainant. c) The balance amount of Rs.19,000/- is paid today by way of cash by the accused to the complainant. Hence, upon receipt of which the complainant has acknowledged the receipt of the entire settlement amount of Rs.4,50,000/- (Rupees Four Lakhs and Fifty Thousand only). d) Both the parties duly acknowledge the receipt of the same. As the dispute between the parties with respect to the cheque amount is settled amicably and there is no due from the accused to be paid to the complainant both the parties mutually agree that they will not file any cases against each other for the same cause of action before any court or forum." 2.
