Petitioner has filed this petition seeking following relief (s) :- “10.1 Issue a writ, order, or direction directing the Respondents to forthwith dispose the petitioner’s application to sanction medical leave for 01.12.2024 to 17.03.2025 and release the withheld salary for the same period. BALRAM PRASAD DEWANGAN Digitally signed by BALRAM PRASAD DEWANGAN 2 10.2 Direct that the said representation dated 18.03.2025, 02.04.2025 and 18.08.2025 be decided expeditiously, within a time to be fixed by this Hon’ble Court. 10.3 Award interest on the delayed salary and direct payment of litigation costs to the petitioner. 10.4 Grant such other relief (s) as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case. 2. Learned counsel for petitioner submits that petitioner was transferred from District – Durg to District Kabirdham on 29.11.2024, however, after passing of an order petitioner became ill and could not able to join at transferred place and at the same time, petitioner has also challenged the order of transfer by filing writ petition. Petitioner has submitted an application for grant of medical leave for the period from 01.12.2024 to 17.03.2025 and to release salary of that period, however, application/representation is still pending consideration and no decision has been taken. He also contended that petitioner has submitted representation on 18.03.2025 and reminder representation on 02.04.2025, 13.08.2025, however, till date, representation submitted by petitioner has not been considered and decided nor application for grant of medical leave is decided. 3. Learned counsel for State-respondents submits that from the relief as prayed for in the writ petition, primarily it is appearing that grievance of petitioner is that application submitted by him is not considered and no order has been passed sanctioning medical leave and further representation submitted by petitioner in that regard is also not considered and decided. He submits that if decision is still pending 3 consideration on the application submitted by petitioner, for sanctioning medical leave, it will be considered in accordance with law. 4. Considering the submission made by learned counsel for respective parties, this petition is disposed of directing respondents to consider the pending representation dated 18.03.2025, 02.04.2025 and 13.08.2025 and application for sanction of medical leave, in accordance with law expeditiously preferably within further period of two months from the date of receipt of order. 5.
