HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 24434 of 2026 Court No. - 45 HON'BLE SALIL KUMAR RAI, J. HON'BLE PADAM NARAIN MISHRA, J. 1. Heard learned counsel for the petitioner and learned AGA for the State- respondent nos. 1, 2 & 3. 2. The present writ petition has been filed challenging the FIR dated 29.08.2026 registering Case Crime No.206 of 2026, under Section 109 of B.N.S., 2023, Police Station Bharthana, District Etawah. 3. It has been argued by the learned counsel for the petitioner that recitals in the first information report itself disclose that no offence has been committed by the petitioner. The recitals in the first information report are false. There are no tell-tale signs of the incident, as there are no bullet marks on the wall, which should have been the case, in case the recitals in the first information report are true. It has also been argued that the first information report has been lodged for mala fide reasons as the informant has been charged for an offence registered at the instance of the petitioner. It has also been argued that for the aforesaid reasons, the first information report is liable to be quashed. 4. Learned AGA has opposed the present petition. 5. In view of the order proposed to be passed, it would serve no useful purpose by issuing notice to respondent no. 4 and calling for a counter affidavit. 6. Accordingly, without entering into the merits of the case and after Versus Counsel for Petitioner(s) : Anand Gangwar, Km Astha Counsel for Respondent(s) : C.S.C. Tejveer .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) considering the arguments of the counsel for the petitioner, the writ petition is disposed of with a direction that the petitioner shall not be arrested in pursuance of the First Information Report dated 29.08.2026 registering Case Crime No.206 of 2026, under Section 109 of B.N.S., 2023, Police Station Bharthana, District Etawah, till submission of the police report/charge-sheet under Section 193 of Bhartiya Nyaya Sanhita, 2023.
