Parasar, learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023, praying for granting bail to the petitioner, namely, Abhishek Bhardwaj, who was arrested in connection with Sorbhog P.S Case No. 88/2026, corresponding to G.R No.891/2026
under
Sections 305(c)/314/316(3)/317(3)/318(2)/61(2)(a) of the BNS, 2023 . 3. The petitioner was arrested on 25.07.2026. The forwarding report of the petitioner before the learned Chief Judicial Magistrate, Barpeta reveals that the petitioner had been arrested as he was acting as the booking agent for the transportation of a consignment and statements collected during investigation indicated his alleged involvement. The custodial interrogation was necessary to trace the persons to whom the consignment from the truck had allegedly been sold. 4. The learned counsel for the petitioner has submitted that the petitioner is a booking agent and he had merely booked the consignment on a truck from Noida to Amingaon, Kamrup, Assam. The truck was found in an abandoned condition in a partially submerged in a pond. 5. The learned counsel for the petitioner submitted that the petitioner has suffered incarceration long enough for the investigating authority to have interrogated him in custody. He accordingly prays that the petitioner may be
Page No.# 3/4 allowed the privilege of bail at this stage. 6. The learned Additional Public Prosecutor has submitted that the investigation is still in progress and in view of the value of the goods estimated at more than Rs. 44 Lakhs, the prayer for bail may not be considered. 6. I have gone through the records submitted with the bail petition, and I have also heard the learned counsel for the contesting parties. 7.
Having regard to the length of detention and the grounds of arrest being for custodial interrogation, I am of the prima-facie view that further custodial interrogation of the petitioner at this stage may not be required, in the event, it is ensured that the petitioner continues to participate in the investigation process. 8. Accordingly, the above-named petitioner shall be released on bail on furnishing a bond of Rs.15,000/- (Rupees Fifteen Thousand) only with two sureties of the like amount, one of them being a local surety and subject to the following conditions :- (i) That the petitioner shall not leave the jurisdiction of the Investigating Officer or the learned CJM, Barpeta without prior permission; (ii) That the petitioner shall not hamper or tamper with the evidence. 9. The learned CJM, Barpeta shall be at liberty to impose such other conditions as may be necessary to ensure that the petitioner participates before the investigating authority as and when required to do so. 10. Any violation of the aforesaid conditions may entail cancellation of the privilege of bail. Page No.# 4/4
