The petitioner is apprehending his arrest in connection with Hazaribag Sadar PS Case No.67 of 2021, for offence registered under section 420/34 of IPC, Section 7 of Lottery (Regulation) Act and section 11 of Public Gambling Act, pending in court of learned Chief Judicial Magistrate, Hazaribag. 3. Learned counsel for petitioner submits that the name of the petitioner has surfaced in the present case from the mouth of the co-accused namely Anand Mohan Prasad who was apprehended on the spot and the similarly situated co-accused persons have been granted anticipatory bail in ABA Nos.10622 of 2023 and 6390 of 2024. He next submits that the petitioner has got no criminal antecedent as disclosed in paragraph no.14 of the petition. 4. Learned State counsel opposes prayer and submits that allegations is there of selling lottery tickets on false assurance. 2026:JHHC:13809 2 5. Considering that the name of the petitioner has surfaced on the confessional statement of the apprehended co- accused and the similarly situated co-accused persons have been granted anticipatory bail as aforesaid and the petitioner has got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before learned court within two weeks from today, and in event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to the satisfaction of learned Chief Judicial Magistrate, Hazaribag, in connection with Hazaribag Sadar PS Case No.67 of 2021, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
