ORAL ORDER
The petitioner, a Society registered under the provisions of the Karnataka Societies Registration Act, 1960 on 01.01.2026 with the objective of operating as a recreational facility for its members, is aggrieved by the alleged acts of the respondents in shutting down its premises insisting upon it to operate as a recreational facility only upon obtaining a license.
The petitioner, relying upon the orders of this Court in W.P.No.22962/2025 and W.P.No.28925/2025 decided on 02.12.2025, seeks directions to the respondents not to impose restrictions in consonance with the directions issued by this Court, and Mr. N. S. Sriraj Gowda, the
learned counsel for the petitioner contending that the respondents have shut down the petitioner's operations within 15 days to possibly aid the entities that are operating similar facilities in the vicinity.

2. This Court had called upon the learned Additional Government Advocate to secure a report from the jurisdictional police. The jurisdictional police, who was present before this Court on the previous hearing, has reiterated the submissions by the learned Additional Government Advocate that the petitioner had not even commenced its operations. This Court, deferring further orders, has permitted the petitioner to file an affidavit along with the photographs.
3. The petitioner's Secretary has filed his affidavit along with the photographs. In the affidavit, the Secretary has reiterated the petition averments and certain photographs have been produced. Mr. N. S. Sriraj Gowda and Mr. Aditya Diwakara, the learned Additional Government Advocate, are heard on perusal of these photographs and some of these photographs read as under:

This Court must observe that if the petitioner has to operate a recreational facility, it would be incumbent on the petitioner to ensure that all the amenities that are reiterated by this Court in W.P.No.28925/2025 is in place and in fact, this Court in the afore petition has issued directions with the petitioner therein stating on record that every facility would be put in place. Insofar as the reliance on this Court in W.P.No.22962/2025, this Court must observe that this Court's directions are also

predicated on the due compliance on the amenities and the measures that have to be in place. The petitioner will have to ensure these are in place and for that, the petitioner must have unhindered access. This Court's interference is necessarily in the light of these observations and hence, the following.
ORDER [a] The petition stands
disposed of observing that it shall be open to the petitioner to keep its premises open to ensure all the amenities and facilities in terms of this Court's order referred to in W.P.No.28925/2025 and W.P.No.22962/2025 are available in the premises. [b] The petitioner shall commence its operations once all the amenities and facilities are put in place. [b] The respondents [the jurisdictional police] shall not restrict the petitioner

from opening the premises to ensure that those facilities are put in place. [c] If there is any contravention, it should be open to the jurisdictional police to take action in accordance with law.
