This is an application filed under Section 483 of BNSS, 2023, praying for grant of Page No.# 2/3 bail to the accused-applicant in connection with South Salmara P.S. Case No. 30/2026, registered under Sections 316(2)/318(2)/336(3) of the BNS, 2023. 3. The allegation against the accused-applicant is that, being the headmaster of 1042 No. Lower Primary School, has fraudulently withdrawn certain amounts from the fund granted by the Government of Assam to the school. 4. The FIR was reported by the president of the School Management Committee. 5. The learned counsel appearing for the accused-applicant submits that he is behind the bars for last 60 days and therefore, should be granted default bail. 6. The learned Addl. PP, Mr. Goswami, has submitted that charge-sheet is yet to be filed in the instant case. 7. Taking into account the aforesaid submission, this court directs that the accused- applicant be released immediately on bail, on furnishing a bail bond of Rs. 20,000/- (Rupees Twenty Thousand) only, with one surety of like amount to the satisfaction of Chief Judicial Magistrate, South Salmara, subject to the condition that:- 1. The accused-applicant shall co-operate with the investigation as and when required; 2. He shall not tamper with the evidence or interfere with the school management or witnesses; 3. He shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or to the Investigating Officer. 8.
