JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, the petitioner seeks the following reliefs: “(a) Call for the records from the Respondents in respect of Annexure-G and Annexure-H; (b) Issue a writ of Mandamus directing the Respondents to issue proper posting order to the petitioner in the post Chief Officer Grade II Community Affairs Officer; (c) Direct the second Respondent to make payment of salary and other allowances to the petitioner for the period from 17.08.2017 to 30.07.2018 for having rendered the service of Chief Officer in Sullia Pattana Panchayath, Dakshina Kannada District; (d) Grant such other reliefs as this Hon’ble Court deems fit in the interest of justice and equity.” 2. Heard learned counsel for the petitioner and learned AGA for the respondents and perused the material on record. 3. Learned counsel for the petitioner submits that prayer (a) does not survive for consideration. He further submits that having regard to the fact that the petitioner has been given posting as a Chief Officer-Grade II, Vitla Pattana Panchayath and was - 3 - HC-KAR NC: 2026:KHC:15897 WP No. 6582 of 2025 promoted as Community Affairs Officer and posted to Saligrama Pattana Panchayat Udupi District, during the pendency of the present petition, it is however submitted that the petitioner was working as a Chief Officer in Sullia Pattana Panchayath from 17.08.2017 till 30.07.2018 and also has not been given salary from for the said period and has also not given salary for the period from 08.11.2024 till 31.03.2025 and the respondents may be directed to make payment of salary immediately, since the non-payment of the salary is causing irreparable injury and hardship to the petitioner. 4. Per contra, learned AGA submits that if reasonable time is granted, the respondent would consider the request of the petitioner and make payment of salary. 5. In view of the aforesaid facts and circumstances and the submissions made by both sides, I deem it just and appropriate to dispose of the petition by directing the respondent to consider the request of the petitioner for payment of salary from 17.08.2017 to 30.07.2018 and from 08.11.2024 to 31.03.2025 and make payment of salary due to the petitioner, within a period of eight weeks from the date of receipt of a copy of this order. - 4 - HC-KAR NC: 2026:KHC:15897 WP No. 6582 of 2025 6.
