3.
Learned Counsel for the applicant would submit that victim is a major girl having love affair with the applicant and she on her own will engaged in making physical relation with the applicant, but under the pressure of her parents she lodged the report against the applicant. The applicant is in jail since 21.09.2025, final adjudication of the case will take its own time and therefore he may be enlarged on bail.
4. On the other hand the counsel for the State opposes the bail application and submits that at the time when the first bail application was dismissed as withdrawn, the victim and her mother were already examined as PW-1 & PW-2 and there is no change in circumstances, therefore, the applicant is not entitled for bail.
5. Considering the submissions made by the counsel for the parties; the nature of allegation and material collected during investigation; the first bail application was dismissed as withdrawn on 05.01.2026 with liberty to repeat the same after examination of material witnesses, however, perusal of document Annexure A/4 it transpires that victim has already been examined on 22.12.2025 as PW-1 and her mother has been examined as PW-2 and thereafter there is no change in circumstances, I am not inclined to release the applicant on bail.
6. Accordingly, the second bail application also stands dismissed at motion stage. Sd/- (Ravindra Kumar Agrawal) Judge inder
