Learned counsel for the petitioner submits this civil miscellaneous petition has been filed with twin prayers firstly to set aside the order dated 30.06.2025 and secondly to set aside the order dated 09.07.2025 passed by the learned District Judge-III, Garhwa in Original Suit No. 03 of 2009. At the outset, the learned counsel for the petitioner does not press the prayer to quash the order dated 30.06.2025 passed by the learned District Judge-III, Garhwa in Original Suit No. 03 of 2009. Accordingly, the prayer to quash the said order dated 30.06.2025 passed by the learned District Judge-III, Garhwa in Original Suit No. 03 of 2009 is rejected as not pressed. So far as the order dated 09.07.2025 is concerned, the learned counsel for the petitioner submits that the petitioner seeks permission of this Court to withdraw this civil miscellaneous petition with liberty to raise the grounds mentioned in the petition at appropriate stage before the appropriate court. This civil miscellaneous petition is dismissed as withdrawn with the aforesaid liberty. The interim relief granted earlier vide order dated 20.12.2025 is vacated.
