Kausik (Rejected) CRM (NDPS) 134 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Baishnabnagar Police Station Case No. 918/2024 dated 02.09.2024 under Section 21(C)/25/29 of the NDPS Act. And In the matter of : Nayan Sk. @ Firoj Sk. ……Petitioner. Mr. Amitabha Karmakar Mr. Arup Kumar Bhowmick ……for the Petitioner. Mr. Ranabir Roy Chowdhury Mr. Anindya Sundar Chatterjee ……for the State. Learned advocate appearing for the petitioner submits that initially there was recovery of 6 Kgs. 64 Gms. of Brown Sugar from the possession of two accused persons who named the present petitioner. Subsequently, the present petitioner was apprehended and pursuant to his statement, 200 Gms. of Brown Sugar were recovered from his house. Learned advocate for the petitioner submits that the owner of the house namely, Ejajul Hoque was granted bail on 03.10.2025 by a Co-ordinate Bench. However, the case diary which has been produced by the State reflects that at the behest of the present petitioner there was further recovery and initially a co-accused has named the present petitioner. 2 Having regard to the complicity of the present petitioner and the fact that he is in custody for more than 11 months, I am still of the opinion that this is not a fit case for releasing the petitioner on bail. Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 134 of 2026 is dismissed. Case diary be returned to the learned advocate appearing for the State. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
