Mr. Siddhartha Singh, learned counsel for the petitioners. 2. Mr. Sandeep Kothari, learned counsel for the respondents- Nagar Nigam Haridwar. 3. Petitioners have challenged notice dated 02.12.2025 issued by Municipal Corporation Haridwar. By the said notice, petitioners were asked to pay rent @ ₹6,51,546/- per month. 4. Petitioners contend that they have themselves raised construction over the roof of Dharamshala belonging to Nagar Nigam in 1994 and the rate of rent fixed between petitioner and Nagar Nigam was ₹29,412/- per annum; the rent was enhanced to ₹47,113/- per annum in 2021, therefore, the rent cannot be enhanced again in 2025 to ₹6,51,546/- per month. Another grievance raised by counsel for petitioners is that petitioners were not given opportunity of hearing while revising the rent to such exorbitant limit. 5. Mr. Sandeep Kothari, learned counsel appearing for Nagar Nigam Haridwar submits that if petitioners have anything to say in the matter, then they can be permitted to submit reply to the notice dated 02.12.2025 and the Competent Authority will examine the issue raised by petitioners and pass fresh order, as per law. 2026:UHC:239 6. The writ petition is, accordingly, disposed of with liberty to petitioners to treat the notice dated 02.12.2025 as a notice for enhancing the rent. Petitioner shall be at liberty to submit reply to said notice within two weeks from today. The Municipal Commissioner shall thereafter take decision, after considering petitioners’ reply, as per law, within two weeks thereafter. For a period of six weeks or till decision is taken by Municipal Commissioner, whichever is earlier, no coercive action shall be taken against the petitioner pursuant to impugned notice dated 02.12.2025.
