JUSTICE R DEVDAS ORAL ORDER Learned High Court Government Pleader takes notice for all the respondents. 2. Learned counsel for the petitioner submits that at Annexure-F is the judgment and decree passed by the - 4 - HC-KAR NC: 2026:KHC:14181 WP No. 4770 of 2026 learned II Additional Civil Judge and JMFC, Nanjanagud in O.S.No.457/2013, where the defendants are the Chief Secretary, State of Karnataka, the District Commissioner, Mysore District and the Tahsildar, Nanjangud Taluk, against whom a relief of declaration of title and permanent injunction was sought. A judgment and decree were passed on 17.12.2019 declaring that the plaintiffs are the absolute owners of the suit schedule property, but in respect of the relief of directing the 3rd defendant- Tahsildar, to enter the names of the plaintiffs in the revenue records, the trial Court held that it has no jurisdiction to direct the Tahsildar. Learned counsel submits that despite such a judgment and decree passed by a competent Civil Court, the 3rd respondent-Tahsildar has issued the impugned endorsement at Annexure-A dated 07.08.2025, declining to enter the name of the petitioner in the revenue records on the ground that the lands in question are 'sendi vana' and it is not granted to any person. - 5 - HC-KAR NC: 2026:KHC:14181 WP No. 4770 of 2026 3. Having regard to the judgment and decree passed by the competent Civil Court against the State and its authorities and the said judgment and decree not being challenged by the state and its authorities, the Tahsildar is duty bound to enter the name of the petitioner in the revenue records, having regard to the provisions contained in Sections 127 & 128 of the Karnataka Land Revenue Act, 1964. 4. In that view of the matter, the writ petition is allowed. The impugned endorsement at Annexure-A dated 07.08.2025, issued by the respondent Tahsildar Nanjangud Taluk, is hereby quashed and set aside. The respondent-Tahsildar is hereby directed to proceed to enter the names of the plaintiffs in O.S.No.457/2013, in the revenue records as expeditiously as possible and at any rate within a period of six weeks from the date of receipt of a copy of this order.
